By submitting this form, I declare and confirm on behalf of the Customer the following: 1. that the information provided in this Non-contaminated Soil Declaration Form is true and accurate. 2. that the Customer is the waste producer or has been appointed by the waste producer to manage the waste described in this Non-contaminated Soil Declaration Form. 3. that all waste to be deposited at Sycle will come solely from the nominated address and specific stockpiles/domains specified in this Non-contaminated Soil Declaration Form. 4. the Customer has taken all reasonable measures to assess the soil to confirm that it does not contain Reportable Priority Waste (RPW) as defined by the Environment Protection Regulations 2021 (Vic) and Environment Protection Act 2017 (Vic). 5. that the material: (a) does not contain asbestos; (b) does not contain PFAS or PFOS; and (c) has not been classified as Category A, B, C or D or as Acid Sulphate Soil; and 6. that Sycle maintains the right to reject any material for any reason, including if Sycle suspects that the material is unsuitable, 7. the person who completes this Non-contaminated Soil Declaration Form is duly authorised by the Customer to make the above representations and that Sycle can rely on same; and 8. Sycle has made no representations about the suitability of its services in relation to the material, (collectively, the ‘Customer Warranties’) The Customer indemnifies and holds harmless Sycle and its related body corporate against all loss or damage it suffers as a result of any breach of the Customer Warranties, including but not limited to plant and machinery, disposal fees, labour, loss of income and any associated penalties.
